• A $300 authorization hold will be placed on your card and released after return

E-Bike Rental Waiver & Release of Liability

1. Acknowledgment of Risk
I acknowledge that operating and riding an electric bicycle (“e-bike”) involves inherent risks, including but not limited to loss of control, collision with objects, terrain hazards, equipment failure, and the risk of serious injury or death. I assume all such risks knowingly and voluntarily.

2. Competence & Experience
I represent that I am experienced, physically capable, competent, and familiar with the operation of an e-bike, including its speed, weight, controls, and braking system. I understand that e-bikes handle differently from conventional bicycles.

3. Safety & Helmet Use
I understand and agree that helmets must be worn at all times while riding. I will comply with all safety instructions and all applicable laws, regulations, and traffic rules. I will not operate an e-bike while under the influence of alcohol, drugs, or any substance that could impair my ability to ride safely.

4. Age Requirement
I certify that I am at least 16 years of age. Riders under 18 must have a parent or legal guardian sign on their behalf, who thereby agrees that this waiver applies fully to the minor rider.

5. Assumption of Responsibility
I accept full responsibility for my use of the rented e-bike, including any injury, death, or property damage I may cause to myself, to third parties, or to rental equipment. I will inspect the e-bike before use and notify the rental company of any concerns or defects prior to riding.

6. Release & Waiver of Liability
To the maximum extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the rental company, its owners, agents, employees, officers, directors, volunteers, and affiliates (collectively, “the Released Parties”) from any and all claims, demands, damages, causes of action, or liability, including negligence, arising from or in any way connected with my rental, use, operation, loading, unloading, care, or return of the e-bike. This release includes claims for injury, death, property damage, or loss, whether caused by the Released Parties or otherwise.

7. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties against any and all claims, demands, suits, losses, liabilities, damages, and expenses (including attorneys’ fees and costs) arising out of or related to my rental, use, operation, or misuse of the e-bike, including claims brought by third parties.

8. No Warranty & Condition
I understand that no warranties (express or implied) are made regarding the condition, safety, or performance of the e-bike, and the e-bike is rented “as-is.” I am responsible for returning the e-bike in the same condition as received, ordinary wear and tear excepted.

9. Legal Binding Effect
This Agreement shall be binding upon my heirs, executors, administrators, assigns, and representatives and shall be governed by the laws of the state in which the rental occurs.

E-BIKE RENTAL AGREEMENT & TERMS OF SERVICE

This E-Bike Rental Agreement (“Agreement”) is entered into between Wilmington Vacation Homes (“Company,” “we,” “us”) and the undersigned renter (“Renter,” “you”). By renting or using an electric bicycle (“E-Bike”), you agree to all terms below.

1. RENTAL EQUIPMENT

The rental includes one or more electric bicycles and related equipment, which may include:
• E-Bike(s)
• Helmet(s)
• Lock(s)
• Optional basket(s)
All equipment remains the property of the Company at all times.

2. AGE REQUIREMENTS

• All riders must be at least 16 years of age
• No riders under 16 are permitted under any circumstances
• Renter confirms that all riders meet this requirement

3. ACKNOWLEDGMENT OF RISK

Renter understands and agrees that:
• Riding an E-Bike is inherently dangerous
• E-Bikes are heavier, faster, and require greater skill than traditional bicycles
• Risks include, but are not limited to: falls, collisions, road hazards, equipment failure, serious injury, or death
Renter voluntarily assumes all risks, known and unknown, associated with E-Bike use.

4. EXPERIENCE & FITNESS

Renter represents and warrants that:
• They have prior bicycle or E-Bike riding experience
• They are physically and mentally capable of safely operating an E-Bike
• They understand E-Bike controls, braking, speed, and handling

5. SAFETY REQUIREMENTS

• Helmets are required at all times
• All riders must obey all traffic laws and local regulations
• Riding under the influence of alcohol or drugs is strictly prohibited
• E-Bikes may not be ridden on the beach or in sand
Failure to follow safety rules is a breach of this Agreement.

6. RENTAL PERIOD & RETURNS

Rental time begins at the agreed start time and ends at the agreed return time.

Late Returns
• Up to 4 hours late: Charged as a half-day rental
• More than 4 hours late or any overnight: Charged as a full-day rental
• Late fees will be charged automatically to the card on file

Non-Return
Failure to return equipment may result in charges up to full replacement cost.

7. FEES FOR LOST OR DAMAGED ITEMS

Renter agrees to the following replacement charges:
• Helmet: $75.00
• Lock: $25.00
• Missing or damaged accessories: Replacement cost
• Damaged or lost E-Bike: Up to full replacement value
Normal wear is expected. Damage due to misuse, neglect, or prohibited use is not normal wear.

8. AUTHORIZATION TO CHARGE CARD

Renter expressly authorizes Company to charge the card on file for:
• Late returns
• Additional rental days
• Lost or damaged equipment
• Missing items
• Cleaning or repair costs
• Non-returned equipment
No additional authorization is required.

9. INSPECTION & CONDITION

Renter agrees to:
• Inspect equipment prior to use
• Notify Company immediately of any issues
• Accept equipment “AS IS” once rental begins
Use of the E-Bike constitutes acceptance of condition.

10. RELEASE OF LIABILITY

To the maximum extent permitted by law, Renter releases, waives, and discharges Company and its owners, employees, agents, and affiliates from any and all claims, including those arising from negligence, related to:
• E-Bike rental
• E-Bike use
• Equipment failure
• Injury, death, or property damage

11. INDEMNIFICATION

Renter agrees to indemnify, defend, and hold harmless Company from any claims, damages, losses, or expenses (including attorney’s fees) arising from:
• Renter’s use or misuse of the E-Bike
• Injuries to third parties
• Violations of this Agreement

12. NO WARRANTIES

Company makes no warranties, express or implied, regarding fitness, condition, or safety of the E-Bike. All equipment is rented AS IS.

13. GOVERNING LAW

This Agreement shall be governed by the laws of the State of North Carolina.

14. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties. No verbal statements alter these terms.
